No. 1 ranked McMaster Marauders defeat Western Mustangs 33-27 in OUA football in London

Western Mustangs lost a huge football game.

They lost at least two key players to injury, including their starting quarterback.

And while the final score was close, the Mustangs also realized they have a fair amount of work to do if they want to topple the No. 1 team in the country.

The McMaster Marauders showed why they are the No. 1 team in the country. They built a 28-12 halftime lead and then hung on to defeat the No. 6-ranked Mustangs 33-27 Saturday in Ontario university football play at Homecoming at TD Waterhouse Stadium.

The game virtually guarantees the Mustangs can finish no better than third place in the OUA, meaning they?ll play one home playoff game but get no bye.

But the game might have brought about the Will Finch era at Western a few games earlier than anticipated.

Mustang starting quarterback Donnie Marshall reinjured the ankle, an injury that last season required surgery. He was taken off the field on a cart.

?It?s the same ankle as before,? said Mustang coach Greg Marshall. ?It has a wire in it. Not sure whether the wire stayed intact or what happened. I talked to the Doc . . . when it happens once, it doesn?t usually happen again. Having a second traumatic injury on that ankle is pretty serious.?

The Mustangs will await results of tests to determine what the future holds. But the injury occurred in the last three minutes of the game when Donnie Marshall was trying to escape a rush and was tackled. It looked relatively harmless compared to the beating he?d taken all day by the Marauders.

Marshall was sacked seven times by the Marauders and many other times had to run for his life. He took a dreadful pounding and it's something no quarterback, no matter what size or shape, can take.

The Mustangs also lost defensive back Aaron Hansor to a knee injury.

Hansor is a key member of the secondary and once he went out in the second quarter, Marauder?s quarterback Kyle Quinlan attacked his replacement, Kalvin Johnson.

Johnson then got hurt on a big play in the third quarter and had to leave the game.

But it was that second quarter that changed the game. The Marauders dominated the Mustangs offensively, and defensively, putting up almost 200 yards in one quarter alone.

Meanwhile, the Mustang offence couldn?t run or pass in that quarter.

It all changed in the second half for the Mustang defence. They were determined to keep their offence in the game.

?I was proud of them,? Greg Marshall said. ?They could have quit but they didn?t. We?re going to be OK. We?ll be playing them again.?

While the final was 33-27, the Mustangs made the game appear closer with a touchdown in the final minute.

That touchdown was orchestrated by a drive directed by Finch.

There has been some debate about how ready Finch is to play. That debate has now gone out the window.

The strong-armed Burlington native now looks like he?s going to have to direct the Mustangs for a substantial amount of time.

?I?m ready to play,? Finch said. ?I started off really rough but each week I?m getting better. Coming along with the game, every practice, I?m getting better I think.?

The Mustangs, now 3-2, head to Guelph to play the Gryphons on Saturday.

BOISE -- The Boise State Broncos open regular conference play against the University of New Mexico Lobos on Saturday in Albuquerque.

Kickoff is at 4 p.m.

KTVB TO TELEVISE THE GAME IN HD

The game will be televised live in HD on KTVB and KTFT-Twin Falls.

You can expect a live pre-game show at 3 p.m. hosted by KTVB's Jay Tust and Dee Sarton. Tust will also have a post game interview with Coach Pete immediately after the game. The game will be repeated twice on ?Idaho?s Very Own 24/7? at 9 p.m. Saturday and 8 a.m. Sunday.

The True Blue pre-game show will be shown live on KTVB.COM, but the game itself will not be available online.

BRONCOS?LOOK?TO?JUMP?START?OFFENSE

According to coach Chris Petersen, the Broncos will look to kickstart their offense in Saturday's game as they face what many see as a less-talented opponent.

In Monday's news conference, Petersen silenced the team's critics, saying he wouldn't change any player or coaching roles related to the team's offensive line.

"We just got to get better at what we've been doing," Petersen said.

However, while Bronco Nation may be a bit concerned about the lack of production by the Boise State offense, many are quick to praise the Bronco defense.

And why not?

The Broncos have looked dominant in the first three games of the season, especially when it comes to turnovers. So far, players have logged nine forced turnovers -- six of them interceptions -- while two of those have been returned for touchdowns.

The Broncos' most recent turnover came when 305 pound nose tackle Mike Atkinson rumbled 35 yards to pay dirt against BYU on Sept. 20th.

Yet, Petersen says it's anyone's guess at what could happen this week as the Broncos face the Lobos' triple option offense.

"They hold the ball from you -- you don't get a lot of possessions," Petersen said, describing New Mexico's game play as "awkward."

Coach Pete says that means Saturday's game could be surprisingly tough.

"It's a huge challenge -- because our offense has a new challenge, and our offense has a challenge in terms of getting better."

BIG CHANGES FOR NEW MEXICO COACHING PROGRAM

For the last three seasons, due in large part to NCAA sanctions, New Mexico has been among the worst teams in the country, with just one win in each season.

However, former ESPN analyst Bob Davie was hired as the team's new head coach just this year.

Davie has instituted a new style of game play for the program.

Jay Tust spoke to Davie about his plans for rebuilding the team.

Voter registration problems widening in Florida

(AP) ? What first appeared to be an isolated problem in one Florida county has now spread statewide, with election officials in nine counties informing prosecutors or state election officials about questionable voter registration forms filled out on behalf of the Republican Party of Florida.

State Republican officials already have fired the vendor it had hired to register voters, and took the additional step of filing an election fraud complaint against the company, Strategic Allied Consulting, with state officials. That complaint was handed over Friday to state law-enforcement authorities.

A spokesman for Florida's GOP said the matter was being treated seriously.

"We are doing what we can to find out how broad the scope is," said Brian Burgess, the spokesman.

Florida is the battleground state where past election problems led to the chaotic recount that followed the 2000 presidential election.

The Florida Democratic Party called on the state to "revoke" the ability of state Republicans to continue to register voters while the investigation continues. Oct. 9 is the deadline to register to vote in the Nov. 6 presidential election.

"It is clear that the Republican Party of Florida does not have the institutional controls in place to be trusted as a third-party, voter registration organization," said Scott Arceneaux, executive director of the Florida Democratic Party.

The Republican Party of Florida has paid Strategic Allied Consulting more than $1.3 million, and the Republican National Committee used the group for work in Nevada, North Carolina, Colorado and Virginia.

The company said earlier this week that it was cooperating with elections officials in Florida. It initially said the suspect forms were turned in by one person, who has been fired.

"Strategic has a zero-tolerance policy for breaking the law," Fred Petti, a company attorney, said Thursday.

But late Friday the company put out a lengthy statement on its website and said that it was aware of questionable forms in other counties and that it confirmed in each of those counties that the problem was with "one individual." Strategic said it had more than 2,000 people working in the state of Florida.

Strategic insisted that it has "rigorous quality control measures" and it blamed the Republican Party of Florida for the decision by Republican National Committee to dump the company on Thursday.

"When the Republican Party of Florida chose to make likely libelous comments about our effort and stated that the Republican National Committee suggested us as the vendor, the RNC was put in the unenviable position of ending a long-term relationship for the sake of staying focused on the election," the company stated.

In Florida, it is a third-degree felony to "willfully submit" any false voter registration information, a crime punishable by up to five years in prison.

In recent years, Florida's Republican-controlled Legislature ? citing suspicious voter registration forms turned in by the Association of Community Organizations for Reform Now, or ACORN ? has cracked down on groups holding voter registration drives.

The League of Women Voters filed a federal lawsuit against some of the restrictions and Florida agreed earlier this month to drop a new requirement to turn in registration applications within 48 hours after they are signed. The state has reinstated a 10-day deadline.

The questionable forms tied to the Republican Party have showed up in South Florida, including Miami-Dade, as well as counties in southwest and northeast Florida as well as the Florida Panhandle.

Election officials in Escambia and Santa Rosa counties on Thursday handed over more than 100 suspect forms to local prosecutors. They did so days after officials in Palm Beach County also alerted prosecutors.

Ann Bodenstein, the elections supervisor for Santa Rosa County, said her staff started raising questions after an employee saw a form that changed the home address of a neighbor.

Paul Lux, election supervisor for Okaloosa County, said questionable forms in the Florida Panhandle appear to have all come from Strategic's effort based at the local Republican Party headquarters. He said his office has turned up dozens of suspect forms.

Lux said there have been forms that listed dead people and were either incomplete or illegible. He met with local prosecutors on Friday, but added that his staff was still going through hundreds of forms dropped off by Strategic employees.

Lux, who is a Republican, said he warned local party officials earlier this month when he first learned the company was paying people to register voters.

"I told them 'This is not going to end well,'" Lux said.

But Lux added that he did not blame the Republican Party of Florida.

"I can't place the blame on RPOF if they hired a firm and that firm wasn't following the rules they were given to follow," Lux said.

The state party filed the complaint against Strategic Allied Consulting with state election officials, who late Friday handed the case over to the Florida Department of Law Enforcement.

An FDLE spokeswoman said the agency would not automatically open a criminal investigation, but would review to see if there were "possible criminal acts."

Saturn?s moon Titan shows surprising seasonal changes

ScienceDaily (Sep. 28, 2012) ? Detailed observations of Saturn?s moon Titan have now spanned 30 years, covering an entire solar orbit for this distant world. Dr Athena Coustenis from the Paris-Meudon Observatory in France has analysed data gathered over this time and has found that the changing seasons of Titan affect it more than previously thought. Dr Coustenis will present these results at the European Planetary Science Congress in Madrid on Friday 28th September.

Explains Dr Coustenis, ?As with Earth, conditions on Titan change with its seasons. We can see differences in atmospheric temperatures, chemical composition and circulation patterns, especially at the poles. For example, hydrocarbon lakes form around the north polar region during winter due to colder temperatures and condensation. Also, a haze layer surrounding Titan at the northern pole is significantly reduced during the equinox because of the atmospheric circulation patterns. This is all very surprising because we didn?t expect to find any such rapid changes, especially in the deeper layers of the atmosphere.?

The main cause of these cycles is solar radiation. This is the dominant energy source for Titan?s atmosphere, breaking up the nitrogen and methane present to create more complex molecules, such as ethane, and acting as the driving force for chemical changes. Titan is inclined at around 27 degrees, similar to the Earth, meaning that the cause of seasons ? sunlight reaching different areas with varying intensity due to the tilt ? is the same for both worlds. Says Dr Coustenis, ?It?s amazing to think that the Sun still dominates over other energy sources even as far out as Titan, over 1.5 billion kilometres from us.?

To draw these conclusions data was analysed from several different missions, including Voyager 1 (1980), the Infrared Space Observatory (1997), and Cassini (2004 onwards), complemented by ground-based observations. Each season on Titan spans around 7.5 years, while it takes 29.5 years for Saturn to orbit the Sun, so data has now been gathered for an entire Titan year, encapsulating all seasons.

Dr Coustenis explains why it is important to investigate this distant moon: ?Titan is the best opportunity we have to study conditions very similar to our own planet in terms of climate, meteorology and astrobiology and at the same time a unique world on its own, a paradise for exploring new geological, atmospheric and internal processes.?

Reuters reports ??A Chinese court upheld a $2.4 million tax evasion fine against China's most famous dissident Ai Weiwei on Thursday, ending his long legal battle with the authorities but paving the way for him to be jailed if he does not pay.?

An angry Ai, who was allowed to attend court in person for the first time and without an obvious police presence, said he scolded the judge for being a "shame and a disgrace".

"It (the court) didn't respect the facts or give us a chance to defend ourselves; it has no regard for taxpayers' rights," he told reporters. Read the full story.

You want me to climb what? A new report suggests better, common-sense ways for testing whether children are physically fit.

Forget sit-ups and push-ups. The best way to tell whether schoolchildren are physically fit is a common-sense test of body mass index, whether they can run without getting out of breath, and grip strength, a committee of experts said on Thursday.

As America?s children become fatter and more unfit, schools and the government need to keep tabs on just how fit ? or unfit ? they are, the Institute of Medicine panel said. Ironically, agencies have stopped doing this over the past 30 years. A report issued by the panel is intended to kick-start the process.

?We are very concerned that not a lot of kids meet physical activity guidelines, and that?s why we need to be monitoring their fitness,? says exercise expert Russell Pate of the University of South Carolina, who chaired the panel.? ?The big message here is that between the 1950s and 1980s we were monitoring fitness in American kids?and then they stopped doing it. It has?literally been since the mid-1980s that this has been done in a nationally representative sample of American kids."

At the same time, schools crushed by budget cuts and?the pressure to bring up test scores in reading and math have shortened recess and physical education or even cut them out completely.

Right now, says Pate, there?s not a systematic way to prove that kids are less fit than they were in the 1980s, although common sense and obesity statistics would suggest this is the case. The President?s Council on Fitness, Sports and Nutrition says fewer than one in five kids get the exercise they need. The report suggests ways to test this.

The good news: The much-hated baseball throw and sit-ups are out, Pate told NBC News. ?Some of the approaches that were common are really no longer seen as state of the art,? Pate says.

So what do they recommend? First off, the body mass index or BMI measurement. This comparison of height to weight really does do a good job of singling out who is overweight, the panel says.

For health experts doing national surveys, it?s important to measure not only BMI but waist circumference ? which shows how much unhealthy abdominal fat someone is carrying, as well as skinfold thickness, another measure of fat versus muscle. But schools can simply use BMI, which is very accurate for most of the population, the report says.

Shuttle runs and treadmill tests are very good ways to test cardiorespiratory fitness, they said. The shuttle run does require some equipment and training. ?Kids run back and forth from lines that are 20 meters apart,? Pate said. ?There is a device that beeps periodically. The kids run back and forth between the lines, keeping up with the pace of the beeper.? The beeper ups the pace, and the children run until they can no longer keep up.

Musculoskeletal fitness is a bit trickier to measure because it combines strength, endurance and power. ?Growing evidence supports use of the handgrip strength test and the standing long jump as health-related musculoskeletal fitness test items in youth,? ?the report reads. While neither is a complete measure of all three factors, they?re both pretty good indicators, the committee concluded. Modified pull-ups and push-ups are also alternatives, they said.

Pate notes that many?adults and kids?cannot do even one traditional pull-up. ?The problem with a traditional pull-up is you get a lot of zero scores -- you get a lot of kids that can?t do any,? he said. The modified version has the bar just 3-4 feet off the ground, and the child can hang on at an angle with his or her feet on the ground and pull up that way. ?They are partially supported,? Pate said.

Just last month, the President?s Council on Fitness, Sports and Nutrition said it was phasing out the Youth Fitness Test, which dated back to 1966. The new Presidential Youth Fitness Program prescribes a complex set of standards, not all of which jibe with the Institute of Medicine recommendations.

Pate said it's all a work in progress, with national health leaders setting up a nationally representative survey of fitness in youth.

Syrian rebels bomb army command in Damascus

BEIRUT (Reuters) - Syrian rebels bombed a military complex in Damascus on Wednesday, striking at the heart of President Bashar al-Assad's power and igniting a fire which gutted the army command headquarters.

The Free Syrian Army, the main rebel force fighting to overthow Assad, claimed responsibility for the attack which it said killed dozens of people.

But an armed forces statement said military leaders were unhurt and only a number of guards were wounded in the blasts, which shook the whole city at around 7 a.m. (0400 GMT) before regular working hours.

It was the biggest attack in Damascus since July 18 when a blast killed several senior security officials, including Assad's brother-in-law, the defense and interior ministers.

That attack paved the way for a rebel advance into the centre of the capital, although they have since been pushed back to the outskirts.

Internet footage of Wednesday's fire at the General Staff Command Building in central Umayad Square showed flames engulfing its upper floors, indicating explosives were planted inside the building itself.

The main gate was completely blackened from the fire while all the windows of the building were blown out. Shards of glass littered the nearby streets, Reuters television foootage showed.

The blast gouged a deep crater, apparently where the explosive-laden car blew up.

Residents reported that gunfire rattled out around the district for at least two hours after the explosions. Roads in the area were blocked off as ambulances rushed to the scene.

"All our colleagues in the military leadership, the army staff command and the Defense Ministry are unhurt," Information Minister Omran Zoabi told Syrian Television.

Security forces were chasing "armed terrorists" - a term the authorities use to refer to insurgents waging war to oust Assad.

"It's a terrorist act, close to an important site, that's true. But as usual they failed to achieve their goal," he said.

Activist Sami al-Shami said the main explosions were caused by a suicide car bombing and second car loaded with explosives on the perimeter of the complex.

"Then the fighters went inside and clashed with security inside, while some of the men started to torch the building".

"There must be several security forces dead, there's no way the rebels could have made it in that far, fighting their way in, without killing any security forces," he told Reuters.

That appeared to tally with accounts from residents who heard gunfire and smaller blasts after the first explosions.

"The explosions were very loud. They shook the whole city and the windows of our house were shuddering," one resident reached by telephone said. "Black smoke was rising from the area near the army staff building."

A reporter for al-Manar television, run by Assad's Lebanese ally Hezbollah, said he was in the building after the explosion and saw the bodies of three "armed men", suggesting clashes between security forces and rebels at the site.

MAJOR STRIKE

Another resident said: "I was woken up at four minutes to seven by the first loud explosion. Five or six minutes later there was a second."

"We're used to the sound of artillery but these were very big - bigger than usual. I can hear gunfire still," he said.

He said he saw soldiers on the roof of the nearby Air Force Intelligence building, part of the same military complex which was hit.

Syria's conflict, once a peaceful protest movement, has evolved into a civil war that the U.N. special envoy to Syria, Lakhdar Brahimi, said was "extremely bad and getting worse."

Activists say more than 27,000 people have been killed in the 18-month-old uprising against Assad, and even Damascus has become a battleground.

Pro-Assad gunmen killed at least 16 people in the city on Wednesday, the Syrian Observatory for Human Rights said.

The British-based Observatory said three of those killed in the poor district of Barzeh, which is sympathetic to opposition fighters, were children and six were women.

A correspondent for Iran's English-language Press TV was shot dead by a rebel sniper and its Damascus bureau chief was wounded while they covered Wednesday's explosions, Press TV said.

With no foreseeable prospect of foreign intervention and diplomacy stuck, outgunned rebels have relied increasingly on attacks with homemade bombs, striving to level the playing field against an army using fighter jets, artillery and tanks.

At the annual U.N. General Assembly in New York, French President Francois Hollande sought to shake up international inertia over the crisis by calling for U.N. protection of rebel-held areas.

"The Syrian regime ... has no future among us," Hollande said in a speech. "Without any delay, I call upon the United Nations to provide immediately to the Syrian people all the support it asks of us and to protect liberated zones."

PROTECTION ZONES

Protection for "liberated" areas would require no-fly zones enforced by foreign aircraft, which could stop deadly air raids by Assad's forces on populated areas. But there is little chance of securing a Security Council mandate for such action given the opposition of veto-wielding members Russia and China.

The United States, European allies, Turkey and Gulf Arab states have sided with the Syrian opposition while Iran, Russia and China have backed Assad, whose family and minority Alawite sect have dominated the major Arab state for 42 years.

But Western powers have stopped short of supplying military aid to the rebels to an extent that could turn the tide of the conflict, in part out of fear of arming Islamist militants who have joined the anti-Assad revolt.

In another speech to the General Assembly, Qatari Emir Sheikh Hamad bin Khalifa al-Thani said Arab nations should intervene in Syria given the Security Council's failure to stop the civil war [ID:nL1E8KPBSE]

Qatar, which backs the rebels, called on big powers to prepare a "Plan B" within weeks and set up a no-fly zone to provide a safe haven inside Syria in case mediator Brahimi fails to make headway.

The Qatari emir said he believed Arab and European countries would be ready to take part, despite their public wariness of committing the forces needed for such a mission.

Humanitarian conditions are worsening as the violence drags on. The president of the Syrian Arab Red Crescent, which has been the only relief group on the ground the entire 18 months of conflict, said it was in dire need of supplies.

"We need to concentrate mostly on health and shelter because there are 1.5 million displaced people," Abdul Rahman Attar told Reuters during a visit to Oslo. "We need more of everything."

What is? the relationship between a bank and a customer?

Although Bradley Birkenfeld never became famous as a banker. He was a banker.

In most cases banks do NOT owe a fiduciary relationship to their customers.?? The duty owed by a banker? to a customer now? depends on the nature of the relationship. Some people are mere? customers or creditors of banks. Those? who have ?private banking relationships? may be entitled to a higher standard of care. There are clear cases where a bank does owe a fiduciary duty to a client.? A recent article? in the Ottawa Law? Review suggests? that the nature of the relationship will? now be determined? by the specific facts.? When a bank is giving investment advice, the easier? it is to establish a fiduciary relationship.

What is a fiduciary relationship?

fiduciary relationship n. where one person places complete confidence in another in regard to a particular transaction or one?s general affairs or business. The relationship is not necessarily formally or legally established as in a declaration of trust, but can be one of moral or personal responsibility, due to the superior knowledge and training of the fiduciary as compared to the one whose affairs the fiduciary is handling.

What are the obligations of a fiduciary?

Fiduciary relationships entail trust and confidence and require that fiduciaries act honestly, in good faith, and strictly in the best interests of the beneficiaries of such relationships.

Ordinarily, fiduciaries cannot for personal gain avail themselves of opportunities arising from the discharge of their duties. There are demanding rules that prohibit both profit making and any conflict of interest that goes beyond that which is intrinsic to the relationship. Strictly prohibited are secret benefits in the form of undisclosed kickbacks, commissions, profits and discounts, as well as conflicts of interest that involve business and other personal advantages which may enure to the fiduciary. An improper benefit is usually financial, but can include virtually any form of improper personal gain.

Aspects of? any fiduciary relationship owed by a banker to a client

Assuming the bank owed a fiduciary duty to a client, the bank? had to consider? how its? behavior impacted? on the? client. Although they could not act? illegally, or counsel illegal behavior they could not act in a way that harmed their clients. On the one hand, they certainly should not,? could not, and (in most cases) would not? act in a way to encourage illegal activity. On the other hand, they should not? have proactively, on their initiative and for their own personal profit, contact government agencies to report on client activities. If a client was? acting in an illegal manner, the proper course of action for a fiduciary would be to cease? doing business? with the client. Bradley Birkenfeld may well have stood in a fiduciary relationship to his clients. As a result, his contacting the IRS, may well have breached fiduciary obligations owed to the bank clients. As a result, the those clients compromised by Birkenfeld?s ?whistle blowing?, may have the basis for a lawsuit against the bank.

Bradley Birkenfeld was not just any ?whistle blower?. He was a ?whistle blower? ? who was a possible fiduciary ? who specifically betrayed the trust of his clients for the purpose of profiting at their expense.

The news of Bradley Birkenfeld?s 104 million dollar payout for ?ratting out? his clients has made headlines. Although he received a cool 104 million, he had to serve 40 months in jail. Technically this was not a ?quid pro quo?. It was more likely a case of the ?right hand not knowing what the left hand was doing?. At least one young person regarded this as as ?very cool? ? what a great way to get money. But, what this does do is, send the message that:

When it comes to ratting out your friends, family and neighbors, the U.S. government is open for business! What are the long term implications of this? What does this mean for our society as a whole? How might this change the social relationships (family, community) that are fundamental to what our society has been? I will admit, I had not been thinking about this until I cam across a post from Sovereign Man. I recommend the complete post to you. But, the following excerpt really stood out:

Naturally, US politicians are supportive, saying that Mr. Birkenfeld?s?reward sends a warning message to tax cheats and dodgy bankers around?the world.

Yeah, maybe. It also send a message to every bitter ex-wife,?disgruntled employee, and suspicious neighbor out there: you too can?become unimaginably wealthy by ratting out your friends, family,?clients, and co-workers.

It?s really unfortunate, though not terribly surprising, that Uncle?Sam would seek inspiration from Nazi Germany when it comes to taxes.?Frankly, I think Singapore serves as a much more powerful example.

This particular comparison to Nazi Germany? is unclear. (Although the late night way in which FATCA was adopted does bear similarities to the Midnight Knock on the Door. Interestingly Senator Schumer?s ExPatriot Act has invited comparisons to Nazi Germany. ) But, what about a comparison to East Germany, before the fall of the Berlin Wall? The East German Stasi was a Secret Police organization. The basic idea was that, everybody would spy on everybody. You never knew who would turn you in.? The the following excerpt form an article in Der Spiegel shows? how? little was? required? to turn you in:

A West German pudding. That was all it took. Once the Stasi found out about it, a family breadwinner was fired from his army job and an East German household was plunged into destitution.

Even worse, the family later found out that they had been turned in by a close friend. ?She was watering the plants and went through the cupboards to find a Dr. Oetker dessert,? Vera Iburg, who has worked with files kept by the East German secret police for the last 20 years, told SPIEGEL ONLINE, referring to the snoop. ?What was she doing? She had no business there.

Who was a Stasi agent? The answer was: anybody and everybody. Even Humboldt University Vice Chancellor and Theologian Heinrich Fink was a Stasi informer.

It?s clear that if approached by the Stasi, one had little choice but to cooperate.

What does this have to do with Bradley Birkenfeld, the IRS and the 104 million payout? Well, at a minimum it means that the IRS will reward, people who report on the activities of others. The proof is that they are willing to pay. They even call them ?whistle blowers?. As Sovereign Man points out, this surely will provide incentives to people to spy on each other. What does this mean about the future of American Society? Amazingly, I came across a brilliant analysis which begins as follows:

In 1787, philosopher and economist Jeremy Bentham proposed a new plan for a jail that would allow a very few officials to continuously monitor the inmates. He called his plan the panopticon.

?The essence of it consists, then, in the centrality of the inspector?s situation, combined with the well-known and most effectual contrivances for seeing without being seen,? he wrote in describing his plan. Under the plan, because the inspector?? i.e., the jailer?? could see without being seen, the inmates could never know whether they were being watched or not. As a result, they had to assume that they were under complete surveillance at all times, with the hoped-for result being that they would modify their behavior accordingly.

The watchdog said innocent listeners who identified with the behavior described could be offended by the implication that it was suspicious.

?We also considered that some listeners might be offended by the suggestion that they report members of their community for acting in the way described,? it said, ruling that the ad should not run again.

The Association of Chief Police Officers, which sponsored the commercial, apologized to the ?small number? of listeners who had been offended.

The Metropolitan Police force defended the campaign of which the ad formed a part, saying that ?the behavior listed in the advert was based on trends identified by police and had been included in evidence given at recent terrorism trials.?

Google Inc. (NASDAQ:GOOG) saw its shares hit an all-time high Monday, boosted by investor optimism about the company?s future growth outlook from online advertising revenue.

The stock reached highs of US$749.43 in afternoon trading, up from a previous record set in November 2007 of $747.24.

The Mountain View, California-based web giant is seeing increased demand for its advertising products, including search, display and mobile, and investors disillusioned by other social media companies are taking note.
?
According to digital advertising research firm eMarketer Inc., Google is expected to become the leader in display advertising in the U.S. this year, including banner ads, replacing Facebook Inc. (NASDAQ:FB).
?
eMarketer said it estimates that Google?s U.S. display ad revenue will jump 39 per cent to $2.31 billion this year.
?
Google is the world's No.1 search engine, generating $38 billion in revenue last year. Its search advertising business has broadened into display and mobile advertising, which has contributed to Google?s solid and continually growing revenue.
?
Despite the rosy predictions and increasing revenue, however, Google still faces challenges.

In August, the company announced it was cutting 20 per cent of its workforce - about 4,000 jobs - at its cellphone unit Motorola Mobility, and said it would shut about one third of its worldwide offices. About a third of the lost jobs are based in the U.S.

Google said the move was meant to return Motorola?s mobile devices unit to profitability, after it lost money in fourteen of its last sixteen quarters.

The Internet search company expects to take severance-related charges of up to $275 million mostly in the third quarter, and the remaining severance-related costs by the end of 2012.

I just finished Thou Shall Prosper for probably the third time.? I typically read it at least once a year.? The content, especially when it pertains to business, is superb.? Rabbi Lapin does an excellent job of helping the reader to understand the idea that all people are in a position of service.? It really doesn?t matter if you work for a private or public business, the government, or if you are unemployed.? If you at all interact with anyone, at any time, then you are in the business of service.? I love the concept put forth in the book that business is just the reimbursement for your services, plain and simple.? If you approach business in this manner, then you are never going to be on the side that compensation occurs for deeds not performed.? Many very successful business people are excoriated by those who do not understand this simple concept.?? Those individuals who make up the ?99%? do not understand this concept.? Your level of service, especially service that comes from the heart and soul, is your ticket to your livelihood.? Don?t squander it, and for goodness sake, don?t try to bring down those who discovered this concept long ago.

Everyone knows THE GIVING TREE by Shel Silverstein.? I used to read it to my class and I would get weepy, while they would say, ?Why did he have to get old??? They just didn?t get the aging thing, but it was a perfect time to talk about all the gifts that trees give us. Today I have a tree for you that you can use in a multitude of ways in your classroom.? All it takes is a lunch bag and a little creativity.? Tear (or cut) four strips from the top of the bag to the flap.? Open.? Squeeze the middle of the bag and twist.? There?s your tree and here are some possibilities? Chicka Chicka Boom Boom Tree ? Let children write letters or use letter stickers to make an alphabet tree. Orchard ? What are some different things that grow on trees?? Children can draw or cut fruits and nuts out of construction paper and make their favorite tree. Word Family Tree ? Children choose a rime and then write all the words they can think of that end with that sound. Family Tree ? Children write the names of people in their family on the tree. Spooky Tree ? Twist the ends of each strip to look like old limbs.? You can add bats or owls if you like. Seasonal Tree ? Children tear pieces of orange, red, and yellow paper and glue to the strips to make an autumn tree. Dip a sponge in white paint and use like snow to make a winter tree. Tear pink or white tissue paper into small pieces and wad up.? Glue to the limbs to make a spring tree. Paint the strips green to make a summer tree.? Add birds or butterflies. Fall Centerpiece ? Here?s an idea for you if for a party this fall.? Use a large brown grocery bag to make a tree.? Add autumn leaves to the base of the tree or hang Halloween ornaments on the tree.

Education groups join opposition to union-backed Protect Our Jobs ballot proposal, supporters blast ad saying approval will lead to teacher strikes

GRAND RAPIDS, MI ? Opponents of the Protect Our Jobs ballot proposal say it?s not just businesses objecting to the union-backed measure to enshrine collective bargaining in the state constitution.

Citizens Protecting Michigan?s Constitution said five educational advocacy groups representing school boards and administrators have joined the fight against Proposal 2, saying the ballot proposal would turn back reforms and drive up costs.

The Protect Our Jobs coalition blasted the opposition group, calling it ?shadowy? and criticized an ad that said approving the measure would lead to ?Chicago-style? teacher strikes.

?Collective bargaining gives teachers a voice to negotiate for smaller class sizes so they can better educate our kids, time to complete ongoing training required by law and a say on policies that affect their students,? Protect Our Jobs Leaders said in a release. ?Student learning conditions are often improved by collective bargaining.?

Citizens Protecting Michigan?s Constitution spokesman Nick De Leeuw said the Michigan Association of School Boards; Michigan School Association of Secondary School Principals; Michigan Association of School Administrators; Michigan Association of Intermediate School Administrators; and the Michigan School Business Officials are opposing Proposal 2.

The group said the proposal is an attempt by unions to ?hijack Michigan?s constitution for their own financial gain.?

Attorney General Bill Schuette has said the measure would void all or part of 170 laws affecting public employee unions.

?Locally elected school boards across Michigan are responsible for ensuring our kids get the best possible education and for using our resources wisely, but Proposal 2 would set our schools back, eliminating critical reforms that help students succeed and driving costs through the roof,? said MASB Executive Director Kathy Hayes, representing 600 school boards. ?We urge parents to protect our schools, protect our students and to vote no on Proposal 2.?

MASA Executive Director William Mayes said Protect Our Jobs would cost districts $400 million in potential health care savings alone, forcing districts to cut staff and eliminate programs.

?Principals, like parents, want our students to receive the best education from the best teachers, but Proposal 2 would eliminate teacher evaluation systems and force us back into a seniority system that makes time on the job more important than performance with our students,? said Wendy Zdeb-Roper, executive director of the Michigan Association of Secondary School Principals. ?Proposal 2 threatens critical education reforms that help our kids succeed and we are asking parents to vote no.?

Citizens Protecting Michigan?s Constitution released an ad showing scenes of teachers striking in Chicago and saying approving Protect Our Jobs would lead to such job actions in Michigan.

The group released a Michigan Education Association memo that says strikes would still be illegal in Michigan, but unions would once again be able to negotiate for striking workers to be reimbursed for lost paychecks ? eliminating any penalties for walking off the job.

The group also said the measure would repeal the law requiring school bus drivers to have safety certificates.

Protect Our Jobs leaders lashed out, claiming the ad is ?intended to scare Michigan voters with lies, fear mongering and misleading information.?

The coalition called Citizens Protecting Michigan?s Constitution ?a shadowy front group for corporate special interests.?

?The claims in this ad are false,? Lynn Jondahl, a former Democratic state legislator who also served as the chair of the Michigan Board of Ethics, said in a release.

?Proposal 2 does not change the current prohibition on teacher and public school employee strikes, nor does it change current law regarding safety certificates for school bus drivers, which leave that responsibility in the hands of elected school boards.?

A release from the group said claims in the ad are ?lies.?

?The Proposal 2 amendment language states, ?No existing or future law of the State or its political subdivisions shall abridge, impair or limit the foregoing rights; provided that the State may prohibit or restrict strikes by employees of the State and its political subdivisions.??

Which I installed simply by going to my device manager and telling my computer that there was an Xbox 360 gaming receiver plugged into a certain port (assigned the drivers) and I'm still using the Microsoft Controller software that shows battery life etc.
